VACATION RENTAL

SKI COLORADO AND GAMBLE BLACK HAWK

RENTAL POLICY

CHECK-OUT:   11 a.m.

DEPOSIT POLICY:
*50% of total rental cost is due within 10 days of booking.
*Balance of total rental cost ( including Taxes & $500.00 Security Deposit ) is due 30 days prior to arrival for the spring,
 summer, and fall months ( April 1 to Nov. 30 ) and 45 days prior to arrival in the winter and spring months ( Dec. 1 to Dec. 19
 / Jan. 7 to March 31 ). Reservations arriving between Dec. 20  and Jan. 6, the holiday months, is due by Oct. 15. 

CANCELLATION & REFUND POLICY:
*A $250.00 handling fee will be charged on cancellations made in the summer more than 30 days and the winter more than 60 days prior to arrival.
*100% of the total rental cost will be charged on cancellations made in the summer less than 30 days and the winter less than 60 days prior to arrival, excepting Holiday Bookings, in which 100% of the total rental cost will be charged on cancellations made after Sept. 1, 2007.
*Sorry, partial or pro-rated refunds are not available in cases of weather, lack of snow, poor skiing conditions, health issues or transportation delays. We strongly recommend you obtain " travelers insurance."

SECURITY DEPOSIT:
A SECURITY DEPOSIT OF $500.00 IS REQUIRED, THE PURPOSE IS TO PROTECT OUR HOME FROM PERSONAL ITEMS MISSING AND FROM DAMAGES. IF DAMAGE EXCEEDS THE SECURITY DEPOSIT THE GUEST AGREES THAT HIS/HER CREDIT CARD WILL BE CHARGED TO PAY ANY AND ALL DAMAGE CHARGES ABOVE THE SECURITY DEPOSIT.

LATE CHECK-OUTS:
*Late check-outs must be approved in advance by Todd Gardner, an additional " late check-out fee" will be assessed.


 
ASSUMPTION OF RISKS:
There are risks inherent in and associated with the use of this property, which may include risks of injury to person or property, or death. Certain risks may be more likely to occur in high altitude locales with severe climates, such as where this property is located. Call John Dunham, immediately if there is any matter about which you are uncertain or which you believe may present an unreasonable risk to you. Risks which may be inherent to this property and the location in which it is located may include, without limitation: wet, slippery, or icy conditions both inside and out; falling snow or ice; being in proximity of or use of a bathtub including without limitation risks of, drowning, heart attack, stroke; allergic or other reaction to cleaning or "freshening" products; allergic or other reaction to man made and synthetic materials; actions of third parties not under the control of the property manager or home owner; theft of, or damage to, personal property; electric shock or other injury in the use, or misuse, of any electric appliance or mechanical devise; risk of injury in the use of garbage disposals, trash compactors, steam showers, and other similar appliances. Alcohol and other state-altering substances should not be used or around a bathtub.

I assume these risks, whether enumerated or not, known or unknown, on my own behalf and on behalf of any person under any legal incapacity for whom I may be responsible.

 
LIMITATION OF LIABILITY:
The rental agent's liability shall in no event exceed the amount of the rental payment received regardless of  the kind or extent of injury, cause thereof, claim or legal theory advanced. The owners liability shall in no event exceed the lesser of the rental payment received regardless of the kind or  extent of injury, cause thereof, claim or legal theory advanced. Renter agrees to the foregoing and waives all right to claim damages in excess of  the foregoing amounts, and agrees to be limited for all purposes to such amounts.

SPECIAL POLICY:
*Smoking is not permitted in this residence. A $150.00 fee may be charged for Ozonation if smoking in the home if detected.
*Pets are not allowed in this residence.
 

                                            

 
TENANTS LIABILITY:
Tenant agrees to accept liability for any damages caused to the property ( other than normal wear and tear ) by tenant or tenants guests including, but not limited to, landscaping, misuse of appliances, chairs,  sofas,  beds,  tv's,  and/or equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse Gary & Lorraine Gardner for costs incurred to repair/replace damaged items.


CLEANING:
The property will be inspected and cleaned after your departure. The rental fee you have paid or was included in your rental amount, will provide for four hours of normal cleaning, so that you can enjoy your vacation up to the last moment.  YOU ARE REQUIRED  to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, a appropriate charge will be deducted from your security deposit at the rate of $25.00 per hour.


SLEEPING CAPACITY / DISTURBANCES:
Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: a) Occupancy exceeding the sleeping capacity stated on the reservation confirmation  b) Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcohol beverages by or to persons less than 21 years of age  c) Causing damage to the premises rented or to any of the neighboring properties  d) Any other acts which interferes with neighbors' right to quiet enjoyment of other property  e) Violation of the 10:00 P.M. Noise Ordinance.

 
The main unit is a  gorgeous two-story, 2,600 square foot  private home, named the Rocky Mountain Villa, is off  hwy 119,  located just 4 miles north of  Black Hawk, 57 miles to Denver Airport, 32 miles to Boulder, 23 miles to Golden, 15 miles to Nederland, and 12 miles from Interstate 70 in the Colorado Mountains. This home is a four bedroom with four queens, three doubles, and two twin beds sleeping 16 adults, we also furnish 6 self inflating mats with 6 sleeping bags for  children. There are three full bathrooms, a large kitchen, dinning room, and outside eating with two large picnic tables, large living room with Direct TV and a VCR with lots of kids and family movies, washer and dryer, wood burning stove, and a large 1000 sq. ft. deck to enjoy the magnificent surroundings. The lower unit is named The Cozy Cavern and is a 1,400 square foot private home with two bedrooms and one bathroom, kitchen, a very nice living room and a reading room. The master bedroom has two queen beds with a fireplace, the second bedroom has two twin beds, the living room has a full size convertible sleeper sofas, and the reading room has a full size futon sleeper, this home can sleep 10 adults.
